A DRUNK driver who failed to attend his unpaid work punishment because of a football match has been jailed.

Richard Dewar was locked up after a court hearing was told the 33-year-old had breached a community payback order (CPO) imposed for being almost four times the booze limit.

Dewar, of Newton Street, Catrine, had been handed the community-based punishment after his conviction for driving while drunk, while banned and without insurance on Ayr Road in Cumnock.

Court papers state Dewar gave a breath sample to police on January 29 with a reading of 85 microgrammes of alcohol in 100ml of breath.

The legal limit in Scotland is just 22 microgrammes.

Dewar was also the subject of a driving ban at the time, meaning that he wasn’t insured to drive any vehicle.

At a CPO review hearing, held at Ayr Sheriff Court last week, Dewar’s solicitor admitted the progress report on his client was “not quite so good” – adding that Dewar had been “foolish” and “stupid” to behave the way he did in breaching the order.

The lawyer told Sheriff Siobhan Connelly that Dewar’s father had travelled to court from Glasgow to support his son, and that the father agreed he was “right in saying what a fool he had been”.

Sheriff Connelly said: “This report says he didn’t do what was asked and showed a complete disregard.

“He wouldn’t attend unpaid work because of a football match?”

Dewar’s solicitor said his client wasn’t clear if he made that excuse, as the sheriff flagged the incident on May 18 in the social work report.

Sheriff Connelly revoked Dewar’s CPO and instead jailed him for four months.
