John Robertson, 36, spat at his partner Emma Cullen and launched a vicious tirade at the house they shared in Duke Terrace, Ayr.

But his verbal attack was captured on a mobile phone without his knowledge - landing him in jail.

Depute fiscal Scott Toal told Ayr Sheriff Court how Robertson erupted after he’d necked four litres of cider, on July 30.

They had been out drinking to celebrate the engagement before the barmy kicked off at 9.20pm.

Mr Toal said: “He became aggressive for no reason. He accused her of being unfaithful and called her a cow. He stood over her as she was sitting and started to spit at her.The accused’s sister asked him to stop and she was told it was none of her business.” Mr Toal continued: “She recorded the accused without him knowing and sent the it to another party and asked them to contact the police.” Robertson’s girlfriend went into the bedroom and started to pack his clothes after he was asked to leave.

The police turned up at 10pm and Robertson told them he had only been in a relationship for a few months.

He denied spitting but said he’d been drinking heavily and had drank four litres of cider.

His solicitor Steven Maxwell said they were drinking to toast their future marriage.

He told the court how he was unaware if the relationship would now survive.

Sheriff John Montgomery blasted: “This is a dreadful way to treat your fiance if she is still your fiance now. This was set across a background of a long record with analogous offences.” Robertson was jailed for six months.

He was convicted for behaving in a threatening or abusive manner which was likely to cause a reasonable person to suffer fear and alarm - and also of spitting on Ms Cullen.
