A MAN said ‘ciao’ to nine months in prison for breaching his ABSO and having a ‘party’ with family visiting from Italy.
Paolo Pacitti, of Princes Court Ayr, was issued an anti-social behaviour order in February last year, prohibiting his from playing loud music and having parties and/or gatherings of two or more people between 10pm and 7am.
However, the court heard that Pacitti admitted to breaking this order, for a fifth time, on June 19 at his home address.
The 43-year-old appeared before Sheriff John Montgomery at Ayr Sheriff Court last week.
Depute Fiscal, Cath Whyte, explained: “At around 1.20am, police officers were instructed to the locus because of the excessive noise which had been going on for a number of days.
“This was having an adverse effect on the neighbours. They heard repeated banging on the walls and loud noises.
“When the police attended, the accused became very abusive towards them – he was apprehended for breaching his anti-social behaviour order and for calling one of the officers a ‘fat c**t’ and also calling the officers ‘f**king dafties’.”
Speaking on his behalf, defence solicitor, Quinton Muir, said: “Regrettably, there is a record. On this occasion, the back ground is that his cousin was visiting from Italy – he came back from the pub with a number of acquaintances.”
Addressing Pacitti, Sheriff Montgomery, commented: “This is the fifth time that you have breached your anti-social behaviour order since February last year – that shows me that you are defiant to the order.”
Pacitti was sentenced to nine months in jail.
