A MAN has been jailed after seriously assaulting his partner.

The 29-year-old, who cannot be named for legal reasons, admitted to repeatedly punching his partner on the head and body, seizing hold of her head and pushing her against a window, on February 25 at a property in Ayr.

He appeared before Sheriff Carole Cunninghame at Ayr Sheriff Court last week.

Depute Fiscal, Jason Bell, explained: “The background to this is that the complainer and the accused had been in a relationship for six years, which ended in 2017, however, they have reconciled since then – they have one child together, aged five and the complainer has a seven-year-old daughter.

“On February 25, the accused had been drinking in the morning and continued through to the afternoon. He went to work on his car and asked the complainer to help – she refused.

“The accused became angry and accused the complainer of being unfaithful – the complainer then found alcohol in the car which she removed. This angered the accused.

“The complainer went into the children’s bedroom to get away from the accused. He followed, and he punched her in the face with his right fist, followed with a punch with his left fist, which she managed to block. The complainer contacted a relative to call the police.

“The seven-year-old daughter was also in the room. The complainer told her daughter to go downstairs and the accused followed them.

“The complainers friend arrived and found the accused acting aggressively – the police then arrived and took the accused to Ayr Police Station where he was cautioned and charged.

“The complainer has bruising to her left and right upper arms but refused any medical attention.”

Speaking on his behalf, defence solicitor John Gallagher, said: “[My client] has no recollection of that day and he accepts his involvement in this was an unsavoury episode – it is fair to say that the remorse has been shown in my dealing with him.

“After a while of sobriety, he had consumed a bottle of whisky – he is now trying everything to right these wrongs.”

Addressing the accused, Sheriff Cunninghame, said: “This is a sustained attack in front of a child which must have been terrifying for them. One notes that you have committed this whilst on a community payback order. You require a custodial sentence to reflect this offence.”

The accused was sentence to six months imprisonment and the court made an order under the terms of Children (Scotland) Act 1995.
