A NOISY man who was made subject to an ASBO has been jailed for causing nuisance and distress to his neighbours for excessive noise.

Paulo Pacitti, of Princes Court, admitted shouting and swearing and allowing friends to do the same when they visited his home.

He owned up to banging on the doors, walls and furniture as well as playing music at extreme levels and permitting guests to do the same between January 13 and January 14 this year.

The 42-year-old is on a deferred sentence for breaching his ASBO on December, 4 last year, having only been issues with it three days before, where he and several others within the premises shouted and swore for seven hours.

Pacitti resisted arrest on January 5 at Princes Court and struggled violently with police officers. He pleaded guilty to causing alarm and distress to his neighbours by creating excessive noise through the T.V. These matters will be dealt with in May for him to be of good behaviour while he serves a prison sentence for the incidents which occurred on January 13 and 14.

Pacitti appeared from custody at Ayr Sheriff Court last week before Sheriff John Montgomery. Sheriff Montgomery said: "These complaints speak for themselves."

Depute Fiscal Scott Toal said: "They do. The neighbours were complaining about the noise level. Police officers attended on each occasion to speak to them about the noise level which was quite excessive.

"He was at least warned about that on once occasion."

Speaking on his behalf, defence solicitor Mr McGuire said: "I think it is safe to say that alcohol is a big problem. I think it is fair to say that visitors were using the flat as a drinking den and he found it difficult to remove them. 

"Mr Pacitti knows his only option is to give up alcohol and has been alcohol free from January 23. I see a difference with him today in his demeanour."

Sheriff Montgomery said: "Well we say that about anyone who has a drink problem."

Addressing the dock Sheriff Montgomery said: "I will remind you of the regularity of which you have breached this Anti Social Behaviour Disorder.

"The court cannot ignore the frequency of this breach. A custodial sentence is required. I am going to sentence you to five months imprisonment which should give you sufficient time to sort yourself out in custody which you need.

"In relation to the other complaints, I am going to defer sentence until May when there should be some support for you put in place."

Pacitti has been remanded for five months. He will appear at Ayr Sheriff Court again on May 9.
